一、我们如何收集和处理您的个人信息
我们如何收集您的个人信息
根据《中华人民共和国个人信息保护法》, “个人信息”,是指以电子或者其他方式记录的能够单独或者与其他信息结合识别特定自然人身份或者反映特定自然人活动情况的各种信息,包括但不限于姓名、身份证件号码、通信通讯联系方式、住址、账号密码、财产状况、行踪轨迹等。个人信息的泄漏会对信息主体的个人生活、名誉和身心健康等方面造成严重的负面影响。 因此,我们会采取合规技术对您明确同意和主动提供的敏感信息进行加/密存储,保护您个人信息的安全。如我们通过共享、转让、搜集公开信息等其他渠道间接获取相关您的个人信息时,我们会明确告知您,并只获取实现产品或服务的业务功能所必需的最少数量的信息,且在收集和使用之前明确告知您并征求您的明示同意。同时,我们将在收集信息前确保信息来源的合法性,了解个人信息提供方已获得的个人信息处理的授权同意范围,包括使用目的、授权同意转让、共享、公开披露。若我们开展业务需进行的个人信息处理活动超出该授权同意范围,会在获取个人信息后的合理期限内或处理个人信息前,征得您的明示同意。
我们的产品和服务的一些核心功能和附加功能需要您提供相关的个人信息才能满足这些功能的正常使用,如果您拒绝提供这些信息,您将无法享受到我们提供的产品和服务。以下,我们将会介绍我们需要向您收集的个人信息以及相关原因:
1、手机号码:在您注册Franwell Pro账号时,我们需要收集您的手机号码信息以满足相关法律法规的网络实名制要求。若您采用第三方登录的方式登录我们的产品(例如:谷歌等),我们会向第三方请求您的手机号码信息,如果对方无法按要求提供,我们仍需要您提供。
2、位置信息:在您登录软件后,您可以通过声波配网的方式,连接和绑定智能终端产品。在您进行网络配置时,您需要授权我们获取您的‘定位权限’,获取您当前所在位置的WiFi网络列表,实现摄像机连接您选择的WiFi网络,如果您拒绝向我们开放定位权限,可能会导致设备无法正常进行配网。
3、设备标识符信息:在您绑定智能终端设备时,我们需要收集您的设备标识符信息(设备的UUID、MAC地址、设备序列号、IMSI、IMEI、IP地址、设备ID信息。软件安装列表)以获取该设备的绑定状态(是否已被其它账号绑定)。若通过WiFi连接的智能设备,我们还需要收集WiFi信息(SSID、WiFi名称、WiFi密码)设备标识符信息是具有唯一性的产品基本信息,是绑定产品并进一步为您提供预览、存储视频等基础服务和增值服务而必须收集的基础信息。
4、云视频:我们的视频类产品附带有云视频回放和云视频告警等增值服务功能,当您开通这类服务后,您的视频信息将会上传至云端,方便您随时进行回看。这些视频将会储存在我们的服务器中,我们将会以加密的方式储存您的视频信息,确保这些视频信息不会泄露。
5、购买云录像:云录像为您提供随时通过APP观看和保存智能硬件设备拍摄的历史视频的功能服务。为使用该功能,您需要购买云录像。在您选择购买并支付智能硬件设备的云录像套餐服务时,可通过第三方支付方式(包括微信、支付宝等)实现支付。我们仅获取您购买的商品名称、订单编号、订单金额,以及支付状态,以实现为您提供相关云录像服务,我们不会获取第三支付账号的任何信息。
6、传感器信息:APP扫码配网获取到内容会震动手机,提示用户扫码成功。
7、相机权限:当您使用APP扫描二维码时,或者当您在流量充值功能中使用相机扫描物联网卡卡号时,我们将访问您的设备相机权限,您可在开启相机权限后使用该功能进行扫码识别等功能。请您知晓,我们仅会在您主动授权时获取此权限,并在前台为您呈现拍摄界面。
8、相册权限:当您从手机相册中选择带有可识别二维码的照片,我们需要获取您的相册/存储权限识别获取设备类型及设备序列号以完成添加;您也可以通过此权限将设备截图、录屏保存下来的照片、视频保存到手机相册,并通过此权限将您的图片或视频分享至社交平台,如微信。当您在流量充值功能中使用从相册中获取照片的ICCID号码时,或者在帮助与反馈功能中需要添加图片或视频时,我们同样需要获取您的相册/存储权限识别获取物联网卡卡号或添加手机相册图片以完成功能。
9、麦克风权限:当您使用远程对讲等功能时,您需要开启麦克风权限,我们会相应收集您提交的音频内容,以便为您实现该功能。您可以通过系统设置关闭麦克风权限拒绝我们收集,但这将使您无法使用该项功能。您开启消息提醒功能时,我们会收集您的摄像机拍摄的视频截图,从而将截图作为提醒消息的内容推送给您。您可以通过账户设置关闭该功能。
10、粘贴板权限:当您同意隐私协议后,我们将读取剪切板信息,您在登录页面复制用户账号时,或者在共享设备复制链接时,我们将会向粘贴板中写入您选择复制的信息。这些信息仅供您之后的粘贴所使用,不会收集您的隐私信息。
11、推送告警消息:当您将app置于后台或在静默状态下时,我们需要收集您的设备标识符信息(设备的UUID、MAC地址、设备序列号、IMSI、IMEI、IP地址、设备ID信息、软件安装列表)用于给您推送告警消息。
12、当您使用我们的广告服务时,我们可能会接收并记录您网络设备硬件地址、网络相关信息、设备标识符信息(如设备的UUID、MAC地址、设备序列号、IMSI、IMEI、IP地址、设备ID信息、软件安装列表等在内的描述个人常用设备基本情况的信息)、设备参数信息、软硬件操作系统信息、日期信息、应用信息、位置信息,并共享给我们授权的广告合作商,以在开屏等场景中显示广告
我们如何处理您的个人信息
我们收集个人信息的目的是为了给您提供我们的产品和服务,我们会按照如下规则使用您的个人信息
1、我们会根据本政策的约定并为实现相应的产品与/或服务功能进行使用。
2、我们可能会整合使用您的个人信息及/或我们以合法方式获取的与您的服务或产品使用行为有关的其他信息(下称“其他信息”),以预防、发现、调查欺诈、侵权、危害安全、非法或违反与我们或我们关联公司间协议的行为。
3、提供、处理、维护、改善、开发我们的产品或提供给您的服务,包括售后服务和客户支持,以及通过设备或网站提供的服务。
4、处理您的设备、服务或查询请求(例如更新、客户咨询支持、我们活动的相关信息、通知)等进行交流。
5、我们会对我们的产品与或服务使用情况进行统计,并可能会与公众或第三方共享这些统计信息,以展示我们的产品与或服务的整体使用趋势。但这些统计信息不包含您的任何身份识别信息。
6、当我们展示您的个人信息时,我们会采用包括内容替换、匿名处理方式对您的信息进行脱敏,以保护您的信息安全。
7、储存并维护与您相关的信息,用于我们运营业务或履行法律义务。
8、注意,在以下情况中,我们在处理和使用您的个人信息时,不需要征得您的同意:

二、我们如何使用Cookie和同类技术

3、通过本应用所设cookies所取得的有关信息,将适用本政策。
三、我们如何保存和保护您的个人信息
我们会采取一切合理的预防措施,使用符合业界标准的安全防护措施保护您提供的个人信息,防止数据遭受未经授权访问、公开披露、使用、修改、损坏或丢失。在您使用我们的产品或服务期间,我们将持续保存您的个人信息,当您主动注销账户或者删除个人信息之后,我们将依据相关法律法规注销您的账户和删除个人信息,以避免您的个人信息泄露。
为了防止用户信息在未被授权的情况下被非法访问、修改、窃取、破坏或遗失,我们采用了以下措施保护您的个人信息:
1、我们的网络服务采取了传输安全协议等加密技术,通过https等方式提供浏览服务,确保用户数据在传输过程中的安全。
2、通过采取加密技术对用户个人信息进行加密保存,并通过隔离技术进行隔离。
3、对设备上传的视频文件进行加密传输和储存。
4、设立严格的数据使用和访问制度,采用严格的数据访问权限控制和多重身份认证技术保护个人信息,避免数据被违规使用。我们仅允许授权人员访问个人信息,并要求他们履行相应的保密义务。
5、提高员工的个人数据保护意识,定期举办安全和隐私的保护培训课程。
四、我们如何共享、转让、公开披露您的个人信息
共享
我们不会与任何公司、组织和个人共享您的个人信息,但以下情况除外:
1、在获取您明确同意的情况下,我们会与其他方共享您的个人信息
2、我们可能会根据法律法规规定、诉讼争议解决需要,或按行政、司法机关依法提出的要求,对外共享您的个人信息
3、在法律法规允许的范围内,为维护Franwell Pro、Franwell Pro的关联方或合作伙伴、您或社会公众的利益、财产或安全免遭损害而有必要共享您的个人信息
4、符合您与其他第三人之间有关约定的。
转让
我们不会将您的个人信息转让给其他任何公司、组织和个人,但以下情形除外:
1、随着亿橡信息科技(香港)有限公司的发展,我们及我们的关联公司有可能进行合并、收购、资产转让或其他类似的交易。如相关交易涉及到您的个人信息转让,我们会要求新持有您个人信息的公司、组织和个人继续受此政策约束,否则我们将要求该公司、组织和个人重新征得您的授权同意
2、在获得您明确同意的情形下转让,亦即获得您明确同意后,我们会向其他方转让我们已经获取的您的个人信息
3、满足法律法规、法律程序的要求或强制性的政府要求或司法裁定。
披露
我们仅会在以下情况下,公开披露您的个人信息:
1、获得您的明确同意后
2、基于法律的披露:在法律、法律程序、诉讼或政府主管部门强制性要求的情况下,我们可能会公开披露您的个人信息。
3、 在法律法规允许的范围内,为维护亿橡、亿橡的关联方或合作伙伴、您或其他 亿橡的用户或社会公众利益、财产或安全免遭损害而有必要披露您的个人信息。
4、法律法规规定的其他情形。
根据法律规定,共享、转让经去标识化处理的个人信息,且确保数据接收方无法复原并重新识别个人信息主体的,不属于个人信息的对外共享、转让及公开披露行为,对此类数据的保存及处理将无需另行向您通知并征得您的同意。
五、您的权利
我们将在实现本政策中所述目的所必需的期间内保留您的个人信息,除非法律要求或允许在更长的期间内保留这些信息。我们保障您对自己的个人信息行使以下权利:
1.访问和更正您的个人信息
您可以在Franwell Pro应用中查询和更改您的账号信息和提供的个人信息,包括但不局限于注册手机号、登录密码、用户头像和昵称等信息
2.删除您的个人信息
在以下情形中,您可以向我们提出删除个人信息的请求:
1、如果我们处理个人信息的行为违反法律法规
2、如果我们收集、使用您的个人信息,却未征得您的同意
3、如果我们处理个人信息的行为违反了与您的约定
4、如果您不再使用我们的产品与服务,或您注销了账号;
5、如果我们不再为您提供产品或服务。
3.撤回您的同意或授权
您可以通过删除信息、关闭某项服务或功能、在软件中进行隐私设置、应用权限管理等方式改变您授权我们继续收集个人信息的范围或撤回您的授权。您也可以通过注销账号的方式,撤回我们继续收集您个人信息的全部授权。
请您理解,每个业务功能需要一些基本的个人信息才能得以完成,当您撤回同意或授权后,我们无法继续为您提供撤回同意或授权所对应的服务,也不再处理您相应的个人信息。但您撤回同意或授权的决定,不会影响此前基于您的授权而开展的个人信息处理。
4.注销账号
您可以通过我们公示的方式申请注销您的账号,您可以打开APP-我的-个人中心,点击“注销账号”,根据页面引导申请注销您的账号。当您注销账号后,您将无法再以账号登录或使用我们的产品或服务。您将无法再通过此账号登录、使用前述服务,将无法继续使用。您理解并同意,我们无法协助您重新恢复前述服务。 如您在谨慎考虑后仍决定要注销您的Franwell Pro ID,您可以在您使用我们的产品或服务的相关功能页面注销您的账号。
六、我们如何处理未成年人的个人信息
我们十分重视未成年人的个人信息的保护,我们的产品及服务主要面向成年人。如果您是未成年人,当您在使用我们的产品或服务时需要监护人同意和授权。我们建议未成年父母或监护人为其阅读本隐私政策,并建议未成年人在提交个人信息之前寻求父母或监护人的同意和指导。若您是未成年人的监护人,当您对您所监护的未成年人的个人信息有疑问时,您可以通过本隐私政策第八节的联系方式与我们联系。 如果有事实证明未成年人并未取得监护人同意的情况下注册使用了我们的产品及服务,我们会尽快删除相关个人信息。 如果监护人有理由相信未成年人未经事先同意而向我们提交了个人信息,请尽快联系我们处理以避免不必要的损失或影响。
七、本政策的修订与更新
我们可能会不定期修改、更新本政策,如果决定更改隐私政策,我们会在本政策中、本公司网站中以及我们认为适当的位置发布这些更改,以便您了解我们如何收集、使用您的个人信息,哪些人可以访问这些信息,以及在什么情况下我们会透露这些信息。

(1)我们的服务模式发生重大变化。如处理个人信息的目的、类型、方式等发生变化;
(2)我们在所有权结构、组织架构等方面发生重大变化。如业务调整、破产并购、重组等引起的所有者变更等;
(3)用户信息委托处理、共享、转让或公开披露的主要对象发生变化;
(4)您使用我们服务时权利及其行使方式发生重大变化;

The App allows you to access and view surveillance data captured or recorded by Compatible Hardware (as defined in the Terms of Use)." Surveillance Data" comprises (1) video (and in some cases audio) recordings or live feeds or streams and still photographic images;(2)readings or data from physical or virtual sensors(to the extent offered by or included with Compatible Hardware and supported by theApp), including motion detection sensors, event sensors, temperature sensors, window/ door sensors, passive infrared sensors, water sensors, carbon dioxide sensors and ambient light sensors.
3) Processing in compliance with applicable laws
Apart from the detail activities specified above, we may process your personal data which is permitted or required by applicable laws:
□ Processing is necessary for the performance of a contract or in order to take steps at your request prior to entering into a contract.
□ Processing is necessary for compliance with a legal obligation.
□ Processing is necessary in order to protect the vital interests of data subject or of another natural person.

Our Apps are not designed for children under 16 years of age, or equivalent minimum age in the relevant jurisdiction (refer to“Child” or" Children" below). If we become aware of any personal data related to Children, we will delete that Children's personal data unilaterally,unless otherwise the processing is permitted by applicable law, explicitly consented by the Children's parents or guardians, or deemed necessary for the protection of the Children.
International Transfers
Since we have affiliates around the world to offer you services and we may store your personal data on our servers located in different countries, including United States, Germany, and Singapore. In light of this, your personal data may be transferred outside the region or country where you use the App or Service, which may have different legal rules and level of protection on personal data. In such circumstances, we will take necessary measures to ensure that your personal data is processed in conformity with the applicable laws,including obtaining your consent to the cross-border transfer of your personal data, signing standard contractual clauses approved by the EU Commission when necessary, and taking appropriate technical security measures to safeguard your personal data.

- 服务许可范围。
本协议授予您的权利如下:
2.1 软件的安装和使用。您可以在手机以及其他允许运行的电子设备上安装、使用、访问、展示或运行本软件产品或相同操作系统下的任何早期版本的拷贝。 本软件的主要功能为配合智能硬件产品的使用与控制,用户需与'硬件设备'一起方可使用本软件。
2.2 支持服务。本软件可以为您提供与产品相关的支持服务。任何为您提供的支持性的相关服务都被视为本软件产品的一部分,需要遵循本协议的条款和条件。
2.3 您理解并接受,平台仅提供本《协议》项下相关服务,您因使用本软件及相关服务所需的相关设备、网络(如个人电脑、手机、及其他与接入互联网或移动互联网有关的装置)及所需的费用(如为接入互联网而支付的电话费及上网费、为使用移动网而支付的手机通讯费及流量费等)等均应由您自行承担。
2.4 软件租赁。许可不允许出租、租赁或转借本软件产品。
2.5 软件转让。许可不允许许可、 再许可、 转让。在没有获得“Franwell Pro”服务平台书面授权前,不得转让本软件产品或本软件产品的权利给任何其他人。
2.6 终止。如果您不能完全遵守本协议的条件和条款,在不损害任何其它权利的前提下,平台可以终止本协议。在此情况下,您必须销毁本软件产品的所有拷贝及其所有组成部分。
3. 账号注册及使用规则
3.1 您在使用本软件时可能需要注册一个”Franwell Pro”服务平台账号。 本软件可能支持第三方账号登陆,经您同意后,您可以根据提示使用第三方账号登陆本软件,在该种情况下,您同意”Franwell Pro”服务平台可获取您与登陆相关的信息。
3.2 您申请注册本软件时,应遵守注册规则,提交真实、准确、合法、有效的注册资料、填写必要信息(具体要求以注册、登录页面的要求为准),以满足相关法律规定的要求,并使”Franwell Pro”服务平台及相关第三方在必要时与您联系。
3.3 您应及时、详尽、准确的提交注册材料,您应当对所提供的资料的真实性、准确性、合法性和有效性承担全部责任。如果因注册信息不真实、冒用他人名义注册账号等引起的问题,由您承担责任,”Franwell Pro”服务平台不承担责任。如因您的原因给”Franwell Pro”服务平台或任何第三方造成侵权或损害的,应当承担赔偿责任。
3.4 您理解并承诺,您的账号名、头像和简介等注册信息中不得出现违法和不良信息,不存在冒用、关联、擅自使用相关机构或社会名人等信息或损害他人的著作权、商标权等合法权益的情形。
3.5 ”Franwell Pro”服务平台有权审核您提交的材料,并决定是否核准您的注册申请。若您提交的材料或填写的信息不完整或不准确,则您可能无法通过注册,或无法使用本软件的全部服务或在使用过程中受到限制。
3.6 您应当为您帐号下的一切行为负责,因您行为而导致的您自身或其他任何第三方的任何损失或损害,”Franwell Pro”服务平台不承担责任。您有义务妥善保存您的帐号和密码,并请您不要向任何第三方透露帐号或密码信息。如出现或怀疑帐号和密码遭到他人使用,请尽快通知”Franwell Pro”服务平台,以免您的利益受到损失。您完全理解并同意,任何因您自身过错(包括但不限于转让帐号、与他人共用、自己泄露等)或您所用计算机或手机终端感染病毒或木马,导致帐号密码泄漏、遗失或其他损失后果均由您自行承担,”Franwell Pro”服务平台不承担任何法律责任。
3.7 您不得实施任何赠与、共用、借用、租用、转让或出售帐号等行为。如您违反此约定,”Franwell Pro”服务平台有权对该帐号做出暂停使用、通知您改正、停止服务、直至根据情况注销帐号等处理,且不承担任何法律责任,由此导致的不利后果由您自行承担。
3.8 您不得通过任何手段恶意注册帐号,包括但不限于以牟利、炒作、套现等为目的注册账号。您亦不得盗用其他用户帐号。
3.9 您如须对帐号注销,请按”Franwell Pro”服务平台公示的信息提交申请与审核,但请您勿必知晓,您对账号的注销并不免除您在使用本软件服务期间应承担的责任,且一经注销,账号下的数据、功能、记录等均将无法予以恢复,请您谨慎使用账号注销功能。同时,因注销帐号而产生的全部责任将由您自行承担。
3.10 您注册的本软件帐号的所有权归”Franwell Pro”服务平台所有。注册申请通过后,您将拥有帐号的使用权。”Franwell Pro”服务平台有权根据法律规定、监管部门的要求以及经营需要而收回您所使用的帐号。
3.11 如您设置的帐号名违反法律法规或”Franwell Pro”服务平台关于帐号名的管理规定,”Franwell Pro”服务平台有权对该帐号做出暂停使用、通知改正、停止服务、直至根据情况注销帐号等处理,且不承担任何法律责任,并向主管机关报告。由此导致的不利后果,包括并不限于通讯中断、资料和内容清空、没收收益等不利后果,由您自行承担。
- 版权。
本软件产品包括但不限于任何图像、 照片、 动画、 音频,随附的印刷品和本软件产品的任何拷贝的一切产权和知识产权属于”Franwell Pro”服务平台。本软件产品使用中的内容的一切产权和知识产权财产权利的内容属于相应的所有人,并受到相应著作权或其它知识产权法律和条约的保护。本协议不授予您使用此内容的权利。
禁止反向工程、反向编译以及反向汇编。用户不得对本软件产品进行反向工程、反向编译或反向汇编,同时不得改动编译在程序文件内部的任何资源。
- 免责与责任限制。
用户确认,其知悉本软件所有功能为实现本软件各功能所进行的必要操作,其根据自身需求自愿选择使用本软件以及相关服务,因使用本软件及相关服务所存在的风险喝一切后果将完全由其自己承担,”Franwell Pro”服务平台不承担任何责任。
“Franwell Pro”服务平台不担保网络服务一定能满足您的要求,对网络服务的及时性、安全性、准确性也均不作担保。您对于可能会接触到的非法的、非道德的、错误的或存在其他失宜之处的信息,及被错误归类或是带有欺骗性的发布内容,应自行做出判断。在任何情况下,对于任何信息,包括但不仅限于其发生的任何错误或遗漏;或是由于使用通过本软件发布、私信、传达、其他方式所释出的或在别处传播的信息,而造成的任何损失或伤害,”Franwell Pro”服务平台都不以任何形式承担责任。
“Franwell Pro”服务平台负责向您提供本软件服务。除另有约定外,”Franwell Pro”服务平台对本软件服务不作任何明示或暗示的保证,包括但不限于本软件服务的适用性、没有错误或疏漏、持续性、准确性、可靠性、适用于某一特定用途。同时,”Franwell Pro”服务平台也不对本软件服务所涉及的技术及信息的有效性、准确性、正确性、可靠性、稳定性、完整性和及时性作出任何承诺和保证。
本软件经过详细的测试,但不能保证其与所有的软硬件系统完全兼容,不能保证本软件完全没有错误。如果出现不兼容及软件错误的情况,用户可联系客服,获得技术支持。如果无法解决兼容性问题,用户可删除本软件。
在适用法律允许的最大范围内,对因适用或不能适用本软件所产品的损害及风险,包括但不限于直接或间接的个人损害及风险、商业盈利的丧失、贸易终端、商业信息的丢失或任何经济损失,”Franwell Pro”服务平台不承担任何责任。
”Franwell Pro”服务平台不对您在本软件中相关数据的删除或储存失败负责,请您在发布信息同时做好信息内容备份。”Franwell Pro”服务平台有权根据实际情况自行决定您所上传的内容数据在本软件中的最长储存期限,并在服务器上为其分配数据最大存储空间等。您需要根据自己的需要自行备份本软件中的相关数据。
用户违反本协议规定,对”Franwell Pro”服务平台造成损害的,”Franwell Pro”服务平台有权采取包括但不限于中断使用许可、停止提供服务、限制使用以及法律追究等措施。
您在使用本软件过程中,必须遵循以下原则:
(1) 遵守国家有关的法律和法规;
(2) 遵守所有与网络服务有关的网络协议、规定和程序;
(3) 不得为任何非法目的而使用网络服务系统;
(4) 不得利用本软件服务系统进行任何可能对互联网或移动网正常运转造成不利影响的行为;
(5) 不得利用本软件服务上传、展示或传播任何虚假的、骚扰性的、侮辱诽谤他人的、辱骂性的、恐吓性的、庸俗淫秽的或其他任何非法的信息资料;
(6) 不得侵犯”Franwell Pro”服务平台和其他任何第三方的专利权、著作权、商标权、名誉权或其他任何合法权益。
您在使用本软件时须遵守法律法规,不得利用本软件从事违法违规行为,包括但不限于以下行为:
(1) 违反宪法确定的基本原则的;
(2) 危害国家统一、主权和领土完整的;
(3) 泄露国家秘密、危害国家安全或者损害国家荣誉和利益的;
(4) 煽动民族仇恨、民族歧视,破坏民族团结,或者侵害民族风俗、习惯的;
(5) 宣扬邪教、迷信的;
(6) 散布谣言,扰乱社会秩序,破坏社会稳定的;
(7) 宣扬淫秽、色情、赌博、暴力,或者教唆犯罪的;
(8) 侮辱、诽谤他人,侵害他人合法权益的;
(9) 违背社会公德的;
(10) 有法律、行政法规和国家规定禁止的其他内容的.
- 其他条款
如果本协议中的任何条款无论因何种原因完全或部分失效或不具执行力,或违反任何适用的法律,则该条款被视为删除。但本协议的其他条款仍应有效并具有约束力。
“Franwell Pro”服务平台有权随时根据有关法律、法规的变化以及公司经营状况和经营策略的调整等修改本协议。当发生有关争议时,以最新的协议文本为准。如果不同意协议修改的内容,用户可自行删除本软件。如果用户继续使用本软件,则视为您接受本协议的变动。
如果您不再需要使用本软件或者需要安装新版软件,您可以自行卸载。
“Franwell Pro”服务平台在法律允许的最大范围内对本协议拥有解释权与修改权。

GENERAL PROVISIONS
We hereby specially remind you to carefully read and fully understand this “Franwell Pro” Service Agreement (hereinafter referred to as the “Agreement”).
“Franwell Pro” is a network platform provided by the product supplier for all entities (including but not limited to individuals and organizations) using the “Franwell Pro” service (hereinafter referred to as “Users”), offering video viewing and remote presentation services. This Agreement constitutes a legally binding agreement between you (an individual or an organization) and the “Franwell Pro” service platform. Please be sure to carefully read and understand all rights and restrictions stipulated in this Agreement.
By installing, copying, downloading, accessing, or otherwise using this software product, you indicate that you agree to accept all the terms of this Agreement. If you do not have full civil capacity due to age, intellectual ability, or other reasons, please read this Agreement accompanied by your legal guardian and decide whether to agree to it.
Unless you accept the terms of this Agreement, you have no right to download, install, or use this software or its related services. Once you install, copy, download, access, or otherwise use this software product, it shall be deemed that you have accepted this Agreement and agree to be bound by all its terms.

Scope of Service License
Rights Granted Under This Agreement
2.1 Installation and Use
You may install, use, access, display, or run this software product or any earlier version under the same operating system on mobile phones or other permitted electronic devices. The primary function of this software is to cooperate with and control smart hardware products, and it can only be used in conjunction with hardware devices.
2.2 Support Services
This software may provide you with product-related support services. Any support services provided to you shall be considered part of this software product and shall be subject to the terms and conditions of this Agreement.
2.3 Equipment and Network Costs
You understand and agree that the platform only provides services under this Agreement. Any equipment, networks (such as personal computers, mobile phones, and other devices connected to the Internet or mobile Internet), and related expenses (such as telephone fees, Internet access fees, mobile communication fees, and data charges) required for using this software and related services shall be borne by you.
2.4 Software Leasing
This license does not permit renting, leasing, or lending the software product.
2.5 Software Transfer
This license does not permit licensing, sublicensing, or transferring the software. Without prior written authorization from the “Franwell Pro” service platform, you may not transfer the software product or any rights thereto to any third party.
2.6 Termination
If you fail to fully comply with the terms and conditions of this Agreement, the platform may terminate this Agreement without prejudice to any other rights. In such case, you must destroy all copies of the software product and all its components.

Account Registration and Use Rules
3.1
You may need to register a “Franwell Pro” service platform account when using this software. The software may support third-party account login. With your consent, you may log in using a third-party account as prompted, in which case you agree that the “Franwell Pro” service platform may obtain information related to your login.

You shall be fully responsible for the authenticity, accuracy, legality, and validity of the information you provide. Any issues arising from false registration information or impersonation shall be your responsibility, and the “Franwell Pro” service platform shall bear no liability. If your actions cause infringement or damage to the platform or any third party, you shall bear compensation liability.

You understand and undertake that your account name, avatar, and profile shall not contain illegal or inappropriate information, shall not impersonate institutions or public figures, nor infringe others’ copyrights, trademark rights, or other lawful rights.

The “Franwell Pro” service platform has the right to review your submitted materials and decide whether to approve your registration. Incomplete or inaccurate information may result in registration failure or restricted service use.
3.6
You shall be responsible for all activities under your account. The platform shall not be liable for any loss or damage caused by your actions. You must properly safeguard your account and password and shall not disclose them to any third party. Any loss caused by your fault, including account sharing, transfer, disclosure, virus or Trojan infection, shall be borne by you.

You shall not gift, share, lend, rent, transfer, or sell your account. Violations may result in account suspension, service termination, or account cancellation, and all consequences shall be borne by you.

You shall not maliciously register accounts for profit, speculation, or cash-out purposes, nor steal other users’ accounts.

If you request account cancellation, please follow the platform’s procedures. Account cancellation does not exempt you from responsibilities incurred during use, and all data and records will be permanently deleted and cannot be restored.

Ownership of all accounts belongs to the “Franwell Pro” service platform. Upon approval, you obtain the right to use the account. The platform may reclaim accounts as required by law, regulators, or business needs.

If your account name violates laws or platform rules, the platform may suspend, restrict, or cancel the account and report it to authorities. Any resulting adverse consequences shall be borne by you.

Disclaimer and Limitation of Liability
You acknowledge that all functions of this software are necessary operations to realize its features. You voluntarily choose to use the software and related services, and all risks and consequences arising therefrom shall be borne by you. The “Franwell Pro” service platform assumes no liability.
The platform does not guarantee that network services will meet your requirements, nor does it guarantee timeliness, security, or accuracy. You shall independently judge any illegal, immoral, incorrect, or misleading information encountered. The platform shall not be liable for any losses or damages caused by such information.
Except as otherwise agreed, the platform makes no express or implied warranties regarding the software services, including but not limited to applicability, error-free operation, continuity, accuracy, reliability, or fitness for a particular purpose.
Although the software has been thoroughly tested, compatibility with all software and hardware systems and complete absence of errors cannot be guaranteed. If incompatibility or errors occur, users may contact customer service for support or uninstall the software if issues cannot be resolved.
To the maximum extent permitted by law, the platform shall not be liable for any damages arising from the use or inability to use the software, including but not limited to personal injury, loss of profits, business interruption, loss of business information, or any economic losses.
The platform shall not be responsible for deletion or storage failure of data. Users shall back up their data themselves. The platform may determine data storage periods and maximum storage space based on actual conditions.

User Conduct Requirements
When using the software, you must:
1. Comply with national laws and regulations;
2. Comply with all network service agreements and procedures;
3. Not use the service for illegal purposes;
4. Not disrupt normal Internet or mobile network operations;
5. Not upload or disseminate false, harassing, defamatory, abusive, threatening, obscene, or illegal content;
6. Not infringe the lawful rights of the platform or any third party.
You shall not engage in illegal activities, including but not limited to:
1. Violating constitutional principles;
2. Endangering national unity, sovereignty, or territorial integrity;
3. Disclosing state secrets or harming national security;
4. Inciting ethnic hatred or discrimination;
5. Promoting cults or superstition;
6. Spreading rumors or disrupting social order;
7. Promoting pornography, gambling, violence, or crimes;
8. Insulting or defaming others;
9. Violating public morality;
10. Other prohibited content under laws and regulations.

Other Provisions
If any provision of this Agreement is deemed invalid or unenforceable, such provision shall be deemed deleted, while the remaining provisions shall remain valid and binding.
The “Franwell Pro” service platform may modify this Agreement in accordance with changes in laws, regulations, or business needs. The latest version shall prevail. If you do not agree to the modifications, you may uninstall the software. Continued use constitutes acceptance of the revised Agreement.
If you no longer need to use the software or need to install a new version, you may uninstall it yourself.
To the maximum extent permitted by law, the “Franwell Pro” service platform reserves the right of final interpretation and modification of this Agreement.
